A Washita County man is free on a $25-thousand dollar Surety Bond after being charged with a number of felonies.

27-year-old Payton Thomas Day of Burns Flat was arrested recently after he allegedly choked his girlfriend, threatened and beat her.

According to a probable cause affidavit, the alleged victim called the sheriff’s department five days after the incident telling a deputy that Day snapped and got angry after the two had been drinking on a Friday night in late July.

The court document says that the next thing the victim knew, Day allegedly began pushing her against the inside front door of the house and put his hands around her throat lifting her off the floor, still choking her.

When she told him to leave, he allegedly responded, “No, it’s too late for that” and then slammed her head into the kitchen cabinets three or four times.

When the victim got sick and began throwing up on the side of the couch, Day reportedly left the room only to return with a shotgun saying he was going to kill her and then shoot himself.

Finally, Day told the victim he was tired. She told him to go to bed.  He then grabbed some wet toilet paper, wiped the blood from her face, told her he loved her and then went off to bed.

She filed a protective order against him later that day with Washita County.

Day is due in district court on September 27 for a preliminary hearing conference with the judge.
