An Elk City man is heading back to court and may see his suspended sentence on drug charges revoked and may end up doing time in prison.
51-year-old Tommy Lee Cape has pleaded guilty to three charges of possession of a controlled, dangerous substance over a two year period: twice in 2014 and once last year in May of 2015. One was a criminal misdemeanor and two were felony charges.
Cape was arrested last month on a Beckham County warrant for allegedly violating the terms and conditions of his probation.
According to a violation report, Cape failed to report to his probation officer, was living with a convicted felon and allegedly admitted to his probation officer that he had been using Methamphetamine. He was also ordered to submit random drug screenings and attend support group meetings like Narcotics Anonymous, but the report says Cape hasn’t done either.
He was last sentenced on May 7, 2015 to a term of 10 years in the Oklahoma Department of Corrections on the charge of drug possession and sentenced to one year in the county jail on the charge of possession of drug paraphernalia with the first 10-months suspended on both charges.
Cape is in the Beckham County Detention Center today on bonds totaling $35-thousand dollars and is set to appear next week in Beckham County District Court on a motion hearing to revoke his suspended sentence.
