One person has pled guilty and been sentenced while another is finishing up treatment before she heads back to court on drug charges.
The controlled, dangerous substance charges were levied against the two back in early January.
According to a probable cause affidavit, just after midnight on New Year’s Day, a trooper with the Oklahoma Highway Patrol pulled over a grey Pontiac Sunfire after observing it travel left of center on a city street.
The driver, 34-year-old Danny Shane Tucker told the trooper he had no license. After he was brought back to the trooper’s cruiser, the trooper could smell the odor of alcohol, the court document says. A check with court records also indicated Tucker had a warrant for his arrest.
A search of the Pontiac for open containers allegedly found an opened can of beer and four unopened bottles in the floor near a passenger in the front seat. The passenger was also charged but those were later dismissed.
Also allegedly found was loose marijuana in the back seat floorboard. The OHP trooper wrote in the affidavit that he could smell the odor of raw marijuana inside the vehicle.
A further search of the vehicle turned up a crown royal bag with a black bag inside that contained another container, a plastic bag. The officer said it allegedly contained approximately 2 grams of Methamphetamine. Another plastic bag with skulls on it allegedly had an additional 1 gram of meth.
The court document says a black purse was in the back seat that contained a glass pipe with a burnt residue that the back seat passenger, 39-year-old Shirley Ann Armstrong of Elk City who allegedly stated it belonged to her.
Armstrong and Tucker were both charged with possession of Meth.
Tucker pleaded guilty recently and was sentenced to five years in the custody of the Department of Corrections with all but 60 days suspended with credit for time served and court costs.
Armstrong was transported to a treatment facility on March 16 and is due back in Beckham County District Court on her charges on August 31.
