Elk City Man Jailed Without Bond for Incest & Rape

An Elk City man is in jail with bond denied after charges were filed that he raped and committed incest with his own daughter.

The suspect allegedly admitted following a failed polygraph test that he had sex with the victim.

According to a probable cause affidavit, the victim told an Elk City Police Detective that her father had been raping her since she was seven years old. She is now 18.

Following the accusation, the biological father, 43-year-old David Lewis Britton, agreed to take a polygraph at the police department. After it was completed, according to the court document, “it was known that Britton was deceptive during the test.”

When a detective went over the results of the polygraph with the suspect, Britton allegedly disclosed that he did, indeed, have sex with his daughter and remembered three occasions when the two had sexual intercourse over a several month period beginning after August of 2016 until January 1 of 2018. He also allegedly told police that the incidents occurred in his residence located on West 7th Street in Elk City.

On January 5, 2018, the victim first approached police telling them about the sexual abuse, but couldn’t be specific without becoming emotional.

The affidavit of probable cause states that a week later she was able to elaborate telling investigators that the abuse happened a number of times – at least 10 times – and that she, initially, would resist but her resistance would lead to physical abuse by her father. Later on, she said, “it was at a point that she just started to let the rapes happen without fighting.”

She said the last rape occurred on January 1 of this year and that she moved out of her father’s residence the next day.

The District Attorney’s office has charged Britton with two counts of child sexual abuse and one count of rape even though Britton allegedly admitted to other instances and that a detective recommended three counts of incest and three counts of first degree rape.

Britton is due in court again on April 23 for a preliminary hearing conference and on May 15 for a preliminary hearing in front of Associate District Judge Michelle Roper in Beckham County District Court.
