An Elk City man is in jail on a $100-thousand dollar bond after being charged with a lewd act in the presence of a minor.
Jacob Wayne Merwin is in the Beckham County Detention Facility today and is awaiting a date to meet with his attorney in early December.
Merwin is charged with performing a lewd act in the presence of a minor.
According to a probable cause affidavit, Merwin allegedly unzipped his blue jeans and exposed himself to a five-year-old female as she was watching a movie in bed. The juvenile female later told a forensic interviewer at the Elk city Police Department that Merwin had come into the room and had gotten into bed with her.
The child added that she told Merwin that she was going to go tell her grandmother who was in another room at the time.
She was additionally able to tell the investigator what Merwin had on, blue jeans and a yellow shirt and what the color of the comforter was in the room.
Later, when investigators inspected the room in the residence, pictures were taken of the blue comforter and when Merwin was interviewed the next day, he was found to be wearing blue jeans and a yellow shirt.
The alleged incident happened on Saturday evening, November 4 around 9:30 pm in a home in the county on East 1110 Road.
Merwin told the investigator that the child had come into his room while he was watching television and that she climbed over him and got into bed with him. He later changed his dirty pants and that it was possible she was exposed while he was changing his pants.
Merwin advised that he had drank a half pinto to a pint of vodka, his usual daily amount, prior to the alleged incident.
